Loved Ones

Welcome to Loved Ones. These Terms of Service ("Terms") govern your use of the Loved Ones mobile application ("App"), operated by Randall Montes ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Acceptance of Terms

By creating an account or using the App in any way, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. We may update these Terms from time to time, and your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

2. Account Registration & Eligibility

• You must be at least 13 years old to create an account and use the App.
• You will register using a valid email address and authenticate via a one-time magic link sent to that address.
• You are responsible for maintaining access to your registered email and for all activity that occurs under your account.
• You agree to provide accurate information during registration and to keep it up to date.
• You may not create more than one account per person or create an account on behalf of someone else without their permission.

3. User Conduct

You agree to use the App in a respectful and lawful manner. Specifically, you will not:

• Harass, bully, threaten, or intimidate other users.
• Upload, share, or display content that is hateful, sexually explicit, violent, or otherwise offensive.
• Impersonate another person or misrepresent your identity.
• Use the App for any illegal purpose or in violation of any applicable law.
• Attempt to gain unauthorized access to other users' accounts or any part of the App's infrastructure.
• Use automated scripts, bots, or other tools to interact with the App without our written permission.
• Interfere with or disrupt the App's functionality or servers.

We reserve the right to investigate and take action, including account suspension or termination, against anyone who violates these guidelines at our sole discretion.

4. User-Generated Content

The App allows you to create and upload content, including custom avatar items and other creative assets ("User Content").

• Ownership. You retain all ownership rights to User Content that you create and upload.
• License to Us. By uploading User Content to the App, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, display, reproduce, modify (for formatting or technical purposes only), and distribute your User Content within the App and its associated services (including the marketplace, widgets, and promotional materials for the App). This license exists for as long as your content remains on the platform.
• Representations. You represent and warrant that you own or have the necessary rights to all User Content you upload and that your content does not infringe on the intellectual property rights, privacy rights, or any other rights of any third party.
• Content Removal. You may remove your User Content at any time through the App. We may also remove User Content that violates these Terms or that we find objectionable, without prior notice.

5. Marketplace Rules

The App includes a marketplace where users can share, exchange, and recycle custom avatar items. By participating in the marketplace, you agree to the following:

• All items listed on the marketplace must comply with these Terms and our content guidelines.
• You will not list fraudulent, misleading, or deceptive items. Items must accurately represent what is being offered.
• You will not list items that infringe on the intellectual property rights of any third party (for example, copyrighted characters, logos, or trademarks you do not have permission to use).
• We reserve the right to remove any marketplace listing at any time, for any reason, including but not limited to violations of these Terms.
• We reserve the right to restrict or revoke your marketplace privileges if you repeatedly violate these rules.
• The marketplace does not currently involve real-money transactions or in-app purchases. If this changes in the future, updated terms will be provided.

6. Intellectual Property

• Our IP. The App, including its design, code, graphics (excluding User Content), logos, trademarks, and all other intellectual property, is owned by Randall Montes and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App without our prior written consent.
• Your IP. As stated in Section 4, you retain ownership of the User Content you create. Nothing in these Terms transfers your intellectual property rights to us beyond the license described above.

7. Privacy

Your privacy matters to us. Our collection, use, and handling of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the practices described in the Privacy Policy.

Key points:

• We collect your email address for authentication purposes.
• We may access your contacts (with your permission) to help you find friends who also use the App.
• We do not sell your personal information.

8. Termination

• By You. You may stop using the App at any time. You may delete your account in the App by opening the Your Avatar tab, tapping the gear icon in the top right to open Settings, then selecting Delete Account and confirming. If you cannot access the App, email us at lovedonescontact@gmail.com from the email address linked to your account, and we will help you delete it. We may ask you to confirm that the account is yours first.
• By Us. We reserve the right to suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms, engaged in conduct harmful to other users, or for any other reason at our sole discretion.
• Effect of Termination. Upon termination, your right to use the App ceases immediately. If you delete your account, we will delete your account data and User Content associated with the account, except where retention is required by law or needed for legitimate safety, security, or legal purposes. Sections of these Terms that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.

9. Disclaimers & Limitation of Liability

• As-Is Basis. The App is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the App's reliability, availability, accuracy, or fitness for a particular purpose.
• No Guarantee. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components.
• Limitation of Liability. To the fullest extent permitted by applicable law, Randall Montes and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of content, or loss of use, arising out of or related to your use of the App, regardless of the cause of action or theory of liability.
• User Interactions. We are not responsible for the conduct of any user, whether online or offline. You interact with other users at your own risk.

10. Changes to Terms

We may revise these Terms at any time. When we make changes, we will update the "Effective Date" at the top of this document and notify you through the App or via email. Material changes will be communicated with reasonable advance notice. Your continued use of the App after revised Terms take effect means you accept those changes.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be resolved in the state or federal courts located in the State of New York.
